Wow, just wow, first off the guy/people who spiked the tea need to be found and sentence to death, and the whole heart deal is just disturbing.

charged with first degree murder, that was a mistake. In this country, usually the only way you can be convicted of first degree murder is if it's premeditated and the murderer fully intended to do the act

As you said, he's been charged with first degree murder; not convicted.
The defense will most likely bring it down to second or third degree (but it depends on the system used in California). There's also a torture charge.

my guess is the defense will bring the charge down to Manslaughter. I almost feel sorry for the guilty party here, as that type of drug can cause extremely erratic behavior if the "trip" is bad.
That said, that only stands if the tea was actually spiked. Whoever spiked the tea is directly responsible for the murder as well, and should be charged with manslaughter in the first degree.

this wasn't just a "bad trip" it was the worst possible.
This is what happens when noobs experiment with drugs.
I've eaten mushrooms a bunch and I've only killed myself a few times...
seriously tho, one time I watched my face melt off - but it was kinda cool in a freaky way ;P
I do apologize for any offence taken by my bad humor.

I hear about stuff like this happening with pcp and 'ghetto' drugs, but I've done my fair share of hallucinogens and never have I done or thought of doing anything violent

Mr. Wyatt was able to tell police he'd drank spiked tea, which leads me to believe that he, the spiker and any other tea drinkers were consenting users. I do not get the sense from this brief story that Mr. Wyatt was unaware that he'd been drugged. He is responsible for his actions, but his actions do not meet the pre-meditated requirements for 1st degree. He'll probably have a hard time beating the torture rap and either a manslaughter or 2nd/3rd degree murder charge. A good lawyer may be able to get him off with not much more than minimal jail time, rehab and probation by arguing drug-induced psychosis.

I think the reason his trip was as bad as it was is because it elevated his aggression level. As a cage fighter he already probably has a significant amount of aggression. The shrooms then inhibited his rationale and his aggression was elevated. That coupled with seeing crazy stuff probably lead to that. Hard to stop someone who is trained to fight and has a knife.
I agree with you dansamy. How did he know it was the tea that was spiked? It could have been anything he ingested really, but he pinpointed the tea. More then likely he was in on the spiking.
